Indian News Agency ANI Files Lawsuit Against OpenAI Over Unauthorized Content Usage in AI Training

Indian news agency ANI has filed a lawsuit against OpenAI in the New Delhi High Court, alleging the unauthorized use of its published content to train the ChatGPT AI chatbot. OpenAI has stated that it no longer uses such material for training, but ANI claims its work remains stored in ChatGPT's memory, with no programmed mechanism for deletion.

The case marks another legal challenge for OpenAI, following similar lawsuits in the U.S. by prominent publications such as The New York Times and the Chicago Tribune.

During the initial hearing on Tuesday, the court issued a notice requiring OpenAI to respond to ANI’s allegations. ANI further accused OpenAI of fabricating news stories and attributing them to the agency, according to court documents reviewed by Reuters.

In its filing, ANI provided emails from OpenAI's legal representatives in India, confirming that ANI's website had been blocked internally since September to prevent further usage of its content in AI training. However, ANI maintains that the AI model retains its previously published materials, raising concerns over potential copyright violations.

Responding to the lawsuit, an OpenAI spokesperson stated, “We develop our AI models using publicly available data, adhering to fair use principles and long-established legal standards.” OpenAI has also entered licensing agreements with organizations like the Financial Times and the Associated Press to use copyrighted content legally.

ANI, however, argues that OpenAI has refused to seek proper licensing or permissions for its original content. The agency's filing highlights a broader wave of legal challenges faced by OpenAI and other tech companies accused of using copyrighted works without authorization, including lawsuits from authors, artists, and music publishers.

This case underscores the growing tension between AI developers and content creators over intellectual property rights in the rapidly evolving landscape of artificial intelligence.
